Moscow ID : Prosecution requests No Cameras

The University of Idaho is the economic engine of Moscow Idaho. According to the Moscow Idaho Comprehensive Plan one half of the economy is supported by the University. Thus, the Student population is the driving force of revenue for Latah county originating approximately 60,000 dollars per year of income per student. During the weeks following the murder 25% to 45% of the student body did not return to college. Therefore extreme economic pressure was forced onto the Moscow, Id local police and Idaho state police to find the killer. that is, make an arrest.

Because the Kohberger trial involves members of the student body great economic forces are at stake in Moscow Idaho. These forces may have influenced Moscow, Idaho law enforcement to make a hasty arrest, and Now, motivating the prosecuting attorney to request a secret trial behind closed doors. It appears, in modern day society, that criminal justice has come down to, We found your cigarette butt, similar to the one you just put into the ash tray over there, at the crime scene with your DNA on it. Your Guilty. Case Closed.[1]

Currently, according to the court documents, the camera policy for the trial would have been to allow video capture with a delayed transmission. That is, one of the news media outlets would have set up shop in the court room and filmed the trial proceeding, then dispersed the stream to all who wanted the stream later the same evening after the court had closed. This was the policy for the trial only. However, the defense council has complained that the, as of today, onsite media companies are violating an additional policy set up special for the hearings. Now, since a hearing has been scheduled for September 13, 2023, on the matter of camera policy , and the prosecution case maybe falling apart, the prosecution wants cameras to be excluded. The prosecution believes they can cherry pick what testimonies appear on camera and which ones don't. Well, that is called secrecy. A redacted trial.

We don't have to go to far back in time. The "Spanish Inquisition" and the English common law courts of the "Star Chamber" are examples of what goes on behind closed doors. The question of whether a defendant, in a criminal trial, could wave their right to a public trial, similar to their ability to wave their right to a speedy trial, was addressed in the Supreme Court case of Richmond Newspapers, Inc. v. Virginia. In the Richmond Newspapers, Inc. v. Virginia case the supreme court made the opinion that the court could not close a trial to the public regardless of who our how many wanted it closed. The ruling was 7 to 1. However, this ruling did not specifically state that a open court room translates to a film production. For example, installing cameras in the court room for a larger audience. In fact, the word camera was never used in the hearing before the US Supreme court, but it was 1980 some 40 years ago, and no-one had every heard of the internet. The hearing that occurred in 1980, in front of the Supreme Court, translated to traditional newspaper reporters and the general public who may have wanted to sit in on the proceedings. However in the trial, that this hearing was addressing, questions arose regarding the use of a delayed audio tape recording of the trial. The audio tape was provided in a delayed fashion much like the current rules regarding video in the Kohberger trial. The tape was distorted and unusable thus obfuscating the openness to the public concept. Let's face it, in today's world, if some really hard core skulduggery was in the works, it would not be hard to alter the video stream delay, especially when the Prosecution wants to enable secret testimonies. In a nut shell, if the court room video is not a live stream it is a closed court room.

Let us play, what if, what if some high level government actors were evolved in sex trafficking, extortion, racketeering, ect and wanted to cover their tracks from the public? The University of Idaho is the economic engine of the city, it is a beautiful campus with beautiful people, and in the minds of the City leaders, it must be preserved. The Moscow, Idaho court room is small. The seats could be conveniently packed (no standing in the court room) with loyalist preventing outside non loyalist observers from viewing the court details during sensitive testimony. Then, the time delay video stream is altered using some sort of video/audio profanity delay, or the video just gets just damaged. Thus, the video is unusable, and we cannot see into the past. The deep fake is complete, the public is unaware, and Catholic Bishop Tomás de Torquemada smiles from his grave.

The live stream video is the easiest way to increase the in court seating and provide transparency to the public..
