Bridegan Trial: Shanna Gardner Defense




This case is exposing the flaws in our criminal justice system. First we have the state attorney's office reading confidential electronic media exchanges, between the defendant and her attorney, forcing Judge Kite to bring in a special judge to review the action. Of course, the special judge rules in favor of the state, because they all get paid by the same entity, who is the government. They are on the team of the State of Florida, City of Jacksonville. Judge Kite  proclaims after ruling she is going to do a better job at procedural oversight to prevent future mishaps.  That’s great! but the statement is a subtle admission of indiscretion. That is, we messed up, but we are going to do better in the future.  In sports they call this kind of favoritism, Home Cooking . Let us not be naive,  The State Attorney’s Office, lead attorney, states she didn’t read  the confidential electronic media exchanges, between Shanna Gardner and her attorney,,  who is Jose Baez, an attorney licensed with the Florida bar, but he does not actively practice law in the City of Jacksonville. If you were the lead attorney for the state, would you read the electronic message?  Is the court's decision to leave the current state attorney in place a little too cavalier?  This woman, Shanna Gardener, her fundamental rights have been violated. She is facing a death sentence.

Let us face it. Anyone in the United States could be arrested and have their emails, text messages, and web searches analyzed. By analyzing a large volume of information the authorities could draw just about any conclusion not knowing the context of discussion or the motive at play. For example,   A discussion between two parties about a video game could make someone appear to be a terrorist to an independent examiner without knowing the basis for the conversation. An author doing research for a book could be misidentified as a serial killer by the particular web information populated into their browser. Chats, and web searches are not proof positive regarding anything of substance to a crime without context. 

 Now, we have the police,  according to Attorney Baez Jacksonville Beach Police Detective Chris Johns was  not recording critical conversations germaine to the case at hand.   In addition, part of the case is built on the police deducing a conclusion based on speculation regarding the context of conversations between friends. According to Florida attorney Baez, those conversations were a running joke between friends, and, most importantly, the friends have given written statements to the fact. Who hasn’t made a crass remark about an ex spouse in a humorous way? It was girl talk. Furthermore, during a hearing Detective Chris Johns admits he found no text messages between Shannon Gardner and Henry Tenon, the alleged assassin. Nor, did he find any phone records at all between Gardner and Tenon .  Although the checks to Henry Tenon, the shooter, were from Shannon Gardner’s trust account the checks were signed by Mario Fernadez-Saldana, Shanna Gardner-Fernadez’s husband ( married in 2018) at the time of the shooting. However, were these payments for a contract killing, or associated with some other business dealing? This is a little awkward! How and why did Mr. Fernandez gain control of the Shannon Gardner trust account? Still a direct connection between Shannon Gardner and Henry Tenon cannot be established. The current theory asserts a conspiracy between Mrs. Gardner  and her husband at the time  of Mr. Bridigen’s death, who was Mario Fernandez. However this conspiracy is linked to the Shanna Gardner trust account where Mr. Fernandez signed checks from the account. There is nothing more to establish this conspiracy. Could Mr. Fernandez with control of the trust account have worked solo in the contract arrangements without Mrs. Garner's knowledge? Chivilistic Rivalry between Mr. Bridegan and Señor Fernandez. perhaps? Or was Señor Fernandez is just an independent businessman engaged in normal business transactions caught in a trap by a jailhouse snitch trying to save himself. Let us face it. Henry Tenon: got a good deal with the State Attorney’s office. The State of Florida set aside the sentencing guidelines for this case.  Will we ever know if Henry Tenon was the real killer? and if he was the real killer, what was his real motive. Was Henry Tenon coerced into a confession when faced with the lesser of two evils?
